Jail for goat sex attacker in Malawi

A sexual act of polygamous man with a she-goat has earned him six years imprisonment with hard labour (IHL).

The offence is otherwise referred to as bestiality and is contrary to section 154 of the penal code.

Reports indicate that in 2010, 46, year old Abel Mtandaza of Kumbukani village, T/A Mavwere in Mchinji had sex with a she-goat he found in his tobacco field.

“The suspect was on his way to his tobacco field when he saw a couple of goats tied to a tree. Eventually, the man chose one she-goat and performed the abnormal sexual with it.

“However, a boy who was just nearby caught the man red handed and the suspect eventually fled. The boy reported the matter to his parents who also brought the matter before Namitete Police unit in Lilongwe, ” said Kingsley Dandaula, Assistant public relations officer for Lilongwe police station.

After close to a- half- month on the run, members of community policing police around the area apprehended Mtandaza on January 14, 2013.

The suspect was subsequently brought before the Mapuyu first grade court where he pleaded guilty to the charge.

“In his plea, Mtandaza pleaded with the courts to be lenient in passing sentence arguing that he did not know what he was doing on that particular day.

He further said he had two wives whom he looked after and that he had credit to settle which he had obtained to cater for his tobacco field,” said Dandaula.

However, state prosecutor in the case Sergeant Francisco Malunda asked the courts to pronounce a stiffer sentence since cases of such nature were not common in Malawi.

In making his ruling, first grade magistrate Elia Phiri concurred with the state prosecutor and also attributed that it was difficult to find previous cases of such offences for reference.

The magistrate then went ahead to pronounce the 6 year IHL sentence upon the offender.
