Two Malawitwo teenage boys have been jailed six years for abducting and defiling a 12-year old girl.
The youngsters, Chrispine Mwalabu aged 18 and Francisco Gwedula 19 both from Baluti village T/A Somba, Blantyre pleaded guilty to the offence at Blantyre Magistrates Court .
However, the third accused Nickson Nyondo aged 18 from Baluti village was acquited despite pleading guilty.
First Grade Magistrate Diana Mangwana convicted and sentenced Mwalabu and Gwedula for defilement contrary to Section 138(1) of the Penal Code.
In testimony, Mwalabu and Gwedula alleged that they had agreed with the victim to have sex in Mwalabu’s bedroom at a fee of MK500.00, which they claimed was paid after the sex.
Court documents indicate that the victim is a standard 7 pupil and was defiled aside being tortured.
”On September 07, 2012 night was the eve wedding night at the victim neighbour’s house in Baluti village. The victim without her parents’ knowledge, went to attend traditional dances
with her friends. As they were dancing, the second accused with assistance of his
accomplices dragged the victim to a nearby bush hill whilst covering her mouth with raincoat,” Blantyre Police prosecutor, Constable Martin Thulu, told the court.
Mwalabu is said to have threatened to hit the victim with a broken bottle.
” He also whipped her with a stick as they were dragging her up the hills. They tied her arms and started defiling her one after another from 21:00hours up to 0400hours”.
According to Constable Thulu first to start defiling her was Mwalabu, seconded by Francisco Gwedula, and then Nickson Nyondo.
It was noted that after satisfying their sexual desires, the trio left the victim alone in the bush as they
went back to dance. It was also noted that relatives of the accused persons intimidated the victim after their arrest.
”The victim at around 04:00hours managed to get herself up and went home. She felt pain and blood was oozing. She was crying”.
Medical examination by Dr. Neil Kennedy a Paediatrician at Queen Elizabeth Central Hospital One Stop Center confirmed she was indeed sexually assualted.
Gwedula admitted in court having sex with the girl together with Mwalabu and paid her MK500.00.
He said the victim had been sleeping at his house and it was not the first time to have sex with her.
But in his testimony, Nickson Nyondo, told the court that they had agreed with the victim to have sex at Mwalabu’s house, but he chickened out as it was not proper ‘for three men to have sex with a girl one after another’.
The court acquitted him after cross examination.
