Court orders Standard Bank to produce cheque images to identify cashgate beneficiaries

Standard Bank of Malawi has been ordered by High Court to produce cheque images that show transactions carried on the accounts of companies owned by cashgate convict Oswald Lutepo between April and October 2013 identifying those that benefited from the infamous cashgate scandal. [caption id="attachment_93829" align="alignright" width="434"]Justice Redson Kapindu Justice Redson Kapindu[/caption] The principal beneficiaries Lutepo, whose companies accounted for K4.2 billion (($7.5 million)of the total, was convicted on his own plea of guilty of conspiracy to defraud government of and money laundering. A British-funded audit discovered evidence suggesting that fraudulent cheques were written out in big batches between April and September 2013. Cashgate audit report conducted by British auditing firm Baker Tilly cheques were paid into at least ten different commercial banks throughout Malawi with the highest amount deposited in Standard Bank (49 %).  In comparison the lowest amount (1%) was deposited into OIBM. The report says 22 cheques from 10 different businesses were banked at Standard Bank representing 49% of the ‘cashgate’ funds. Analysis of the cheques deposited into Standard Bank shows the majority of this amount relates to two businesses being;  IPS and O&G Constructions  who  received  MK 1,860,584,273 and MK 1,140,738,209, respectively. “These amounts total MK 3,001,322,562 which is 43.4% of the total ‘cashgate’ cheques. Both businesses are owned by Osward Lutepo,” reads the report in part. The High Court judge Redson Kapindu sitting in Zomba registry on Monday has asked Standard Bank to make available the cheque images by September 2 and has also asked the defence team to make the cheque images available to the court by September 4 when sentencing will take place. Defence lawyer Oswald Mtupila told the court that it was unfortunate that the cheque images the bank provided earlier did not show names of those who received money from the accounts of Lutepo’s Cashgate connected companies, Woget Industries Limited and International Procurement Services. “The bank says its policy does not allow it to give account information to the third party, we really needed this information because it will vindicate my client as he was only used as a channel to siphon money from government coffers hence the ultimate beneficiaries would be known,” he said. He also said he did not intend to dispute findings by an independent evaluator Amos Makalichi Chinkhadze of Lipindi Property Services who was hired by both the state and defence to re-evaluate Woget Industries which Lutepo restituted. The assessor has since found that the company is worth K370 million ($658 363). The property was a subject of controversy following huge discrepancies that followed as earlier the State found that it was worth K293 million ($521 352.31) while the defence said it was worthy K1.427 billion ($2.5 million). The ‘Cashgate’ involved a systematic plunder that involved public officers conniving with private sector firms and  individuals. The scandal led donors to suspend about $150m in budget support and aid to the Southern African nation. Malawi’s International Monetary Fund program also went off track because of the scandal.

Malawi football legend Kinnah Phiri, who was sacked as coach of South African Premier Soccer League (PSL) side Free State Stars on Friday, has said he was unfairly treated but now focus ahead. But the club has said the decision to sack Kinnah is based on the team’s poor start to the season as they have lost all their three PSL games so far this season. Kinnah said: “Yes there has been poor results but the they are to blame for the team’s poor showing because they sold some key players and made R4 million [about K172 million] and I asked them to invest the money by buying quality players which we clearly lacked, but they were hesitant and as a result the team could not perform.” The Malawian mentor said Star were not happy that he was pressing them on” some contractual obligations which they were not fulfilling.” He also accused the South African club of not treating him fairly considering what he did for them last season by taking the team from the murky waters of relegation to ninth position.< “When I took over, the team was at the bottom of the table [16th] and we won five straight matches and lost only one to finish on ninth position, but I guess it is one of those things,” he said. Kinnah now said he is returning home and “life must go on,” Stars are reported to have replaced Kinnah with German Ernst Middendorp.

Malawi Kwacha continues to weaken against Dollar

Malawi currency, the Kwacha has continued on its weaker path onslide against major foreign currencies, and is now being sold in cash at K595 to a dollar according to foreign exchange bureau rates report from Reserve Bank of Malawi (RBM) while on the parallel market or black market it is hitting around K700. Analysts say some major cause of forex shortage is the long-term fertiliser subsidy programme. With all its good intentions—to end hunger thereby contributing to poverty eradication, the subsidy requires thousands of drums of forex to import. Since the programme started in 2005, Malawi has been spending not less than K20 billion annually on the programme. The country’s import bill for fuel, cement, metal bars and other construction materials has spiralled, victims of our own growth. The other cause is the unscrupulous business people who siphon forex out of this country through fraudulent import transfers, hoarding, fake holiday packages and by literally zipping US dollar bills in the trousers while on foreign trips. The fourth cause which has been controversial before is the state travel bill. In the opinion of economist and Press Corporation Limited group chief executive officer, Professor Mathews Chikaonda, kwacha is losing its value because the country is still not able to generate enough foreign exchange to meet its import needs. “We need to accept our reality. Just because we are in the tobacco marketing season is not a guarantee that we will have enough foreign exchange. RBM needs to keep some for the rainy day,” he said. He advises that instead of just being an importing nation, the government needs to seriously implement export diversification drives to help the economy cope during the lean period. The economy is currently facing pressure on the foreign exchange market largely due to speculation despite the country still selling tobacco, which wires in about 60 percent of the country’s foreign exchange earnings.

Director of Public Prosecution Mary Kachale told High Court in Zomba in Malawi that stolen from government in cashgate scandal was used to fund the then governing People’s Party (PP) election campaign and also a presidential aspirant of Malawi Congress Party [MCP]. She said Lutepo’s disclosure has shown that the money that cashgate money was used to fund PP election campaign –where he served as recruitment director – and also funded an MCP presidential candidate to the tune of K11 million. “His [Lutepo’s] declaration statement raises the issues of political party financing, this is a good governance issue,” said Kachale. “From the evidence provided we have also known that People’s Party gave K11 million to one of the Malawi Congress Party [MCP] presidential candidates to disturb MCP election and convention and influence the outcome,” the DPP added/ She, however, refused to name the MCP presidential candidate, saying that would disturb the investigations. Germany agreed to fund a new audit of government finances to find out exactly how much money has been lost and who is to blame. Katrin Pfeiffer, head of development cooperation at the German embassy in Malawi, said the new forensic audit would cover 2009-2013. Pfeiffer said there were suggestions that the looting actually took place over a longer period, before 2009, when the President Peter Mutharika’s brother, Bingu wa Mutharika, was in power. He died suddenly in 2012. Britain is understood to want any investigation to start from 2005 to establish the extent of corruption. The audit will be conducted by PriceWaterhouseCoopers. The theft led international donors, which bankroll the country’s budget by up to 40%, to pull the plug on aid worth $150m last year until the government in Lilongwe cleans up the situation. PP claims that loopholes in the payment system introduced a year after Bingu came into power were to blame for the looting of public funds.

Malawi court sentences son 7 years jail term for raping own mother

The Balaka First Grade Magistrate Court in eastern Malawi has sentenced a 23 year old-man to seven years imprisonment with hard labour for raping his biological mother. The convict Macdonald Kusala was arrested after he was caught red-handed raping his 42-year-old mother in her matrimonial house. Police Prosecutor Inspector Isaac Mponela told the court that Kusala had unlawful sex with his biological mother without her consent at Khoswe village in Balaka district on 21st August, 2015. “The suspect who was drunk undressed and raped his mother in her matrimonial house where he found her sleeping and was caught red-handed by his younger brother who reported the matter to the elders of the family before the victim reported the same to Balaka Police Station who arrested the suspect,” said Mponela. The suspect pleaded guilty to the charge of rape which is contrary to section 133 of the Penal code. In his submission before sentence, Inspector Mponela asked the court to consider giving the suspect a stiffer sentence considering the nature and seriousness of the offence which attracts the maximum sentence of death or life imprisonment. But in his mitigation, Kusala asked for forgiveness saying that he is a first offender and that he raped his mother due to the influence of alcohol. First Grade Magistrate Felix Mandala agreed with the Police that the suspect deserved a stiffer sentence because of the seriousness of the offence and much more, he did it to his own mother which is a taboo. “His drunkenness cannot be an excuse” said Mandala, saying he wondered as to how the suspect managed to go to his mother’s house, undress her and raped her if he was relay intoxicated. He therefore sentenced him to 84 months imprisonment with hard labour. He said he has given him such a sentence so that it should be a lesson to him and would be offenders. Macdonald Kusala who is a second born in a family of six comes from Khoswe village, in the area of Senior Chief Nsamala in Balaka district.  

TNM writes off Bullets K10.3 million CAF debt

Bullets FC can now breathe a sigh of relief as Super League sponsor, Telekom Networks Malawi (TNM) has told the club not pay back the K10.3 million it was owing the country's premier mobile service provider. They got the money on understanding that the would pay back the debt from an SMS promotion the club launched to raise funds for CAF tournament. However, the team only raised K4, 693,800 leaving a deficit of K10, 306,200 and it became apparent the team would find it a tall order to repay the debt because of lack of sponsorship Announcing the news on Tuesday, TNM Chief Commercial Officer Dan Makata said they just thought of relieving team of the debt. “As a proud and patriotic Malawian service provider, we are proud to write-off the debt that Big Bullets owe us as a company. This demonstrates our commitment in supporting the development of football in the country and it is our hope that the debt relief will help Big Bullets FC  focus on other critical operational issues for the team,” said Makata. Makata said as a sponsor, TNM is still proud that Big Bullets presented the country well in the tournament. “We were very moved by Big Bullets’s courage to participate in the competition albeit without stable sponsorship. As a company, we are happy that despite the bottlenecks the team faces due to lack of sponsorship they had the heart to compete at a bigger stage and they represented us well, reaching the second round of the tournament. That is no mean achievement,” he said. Makata explained that whilst they had initially projected to raise K30 million from the promotion, leadership wrangles that eventually led to departure of the previous Big Bullets FC executive derailed the momentum. In his remarks Big Bullets Executive Committee Chairperson Sam Chilunga thanked TNM for reliving the team saying this demonstrates that TNM is a real partner in football development. “ This cancellation  demonstrate the total commitment that TNM has to the development of football in the country as such on behalf of Big Bullets fans I would like to thank the management of the company for this consideration” said Chilunga. Chilunga said with this development the Peoples team will now going to concentrate on building the te*am instead of thinking on how to pay back the money to TNM. “This has also come at right time because it has healed our wounds considering that we are coming from a loss in Carlsberg finals” he said. Apart from the cash advance, TNM also made a separate donation of two sets of uniforms for away and home games worth K1, 160,000. During BB SMS promotion customers were requested to send the word BB to the code 2015 and each SMS costs K50, of which K40 went to the club. Blantyre based Big Bullets fan Jefter Kaponya emerged the grand winner of the SMS promotion and carted home K1 million.

[caption id="attachment_80308" align="alignright" width="377"]Malunga:  Management to make a decision Malunga: Management to make a decision[/caption] Representatives of  University of Malawi Students Union (UMSU) Council say in a statement issued Tuesday that it is very disheartening to note that despite the extended holidays, university and college management fail to come up with sustainable solutions to the problems that forces students to demonstrate. “UMSU 2015-2016 council is pleading with the University Council to tell the public the real reason behind the indefinite closure of the Polytechnic,” reads the statement in part. They however say as the pinnacle of students’ leadership in the premier university (University of Malawi), UMSU Council, does not condone violent demonstrations which its fellowship did at the Poly. “However, any protest or demonstration must be within the law and, must not block streets, right of way, or sidewalks; jeopardize the safety of individuals or the integrity of the college or other property; intimidate, harass, or threaten any member of the public”. Recently, the leaders of Polytechnic Students Union apologized to the general public for the demonstration that led to the closure of their institution saying it was headed by the disgruntled students. However, registrar of the University of Malawi Wokomaatani Malunga told a local media that the institution will only  be reopened once the university management has finalized looking into all issues that led to the demonstrations. But the UMSU says in statement that “closing of college(s) should not be the first resort to reform the behaviour of the students”

PP promotes Msonda to Director of Admin after Rev Kaleso suspension

The opposition Peoples Party (PP) has acted quickly to replace its suspended Director of Administration, Reverend Peter Kaleso by appointing Ken Msonda in acting capacity. And on Tuesday the party's president, Joyce Banda appointed Publicity Secretary, Ken Msonda to act as Director of Administration, casting more doubts on Kaleso's future in the party. According to an appointment letter signed by PP's Secretary General, Ibrahim Matola and Nyasa Times has a copy, Msonda is expected to retain his position of publicity secretary. ''With pleasure I am honoured to inform you that it has pleased the party's founder and President H.E. Dr. Joyce Banda to appoint you as Acting Administrative Secretary (Acting Director of Administrative) with immediate effect,'' wrote Matola. ''Your position as Publicity Secretary remains therefore you shall hold the two offices. I would like to take this opportunity to congratulate you on your appointment and look forward to do your job to the best of your knowledge''. In reaction, Msonda described the appointment as God's grace and favour. ''I thank God for such a recognition. I am humbled. I am not he best among my fellow party members but it is God's Grace and Favour,'' said Msonda. Msonda was full of gratitude to Banda for trusting and believing i him to take up such position. ''I believe with God's guidance, the party leadership's advice and the support from my fellow NEC members  I shall carry out my duties to the best of my ability,'' he added. The party has not disclosed reasons behind Kaleso's suspension but revealed he has been summoned to appear before the party's Disciplinary Committee. Kaleso, however, expressed a surprise when contacted by Nyasa Times on the issue. He said was not officially informed of his suspension and that was shocked with how the party handled the issue. ''Nobody from the party has contacted me on the issue. There is no verbal or written communication; am just hearing it from the media,'' said Kaleso. ''I was in my office the whole day and nobody, even the Secretary General himself, has contacted me that I have been suspended''. Kaleso has since dismissed the discipline charges, arguing he has never been summoned or warned by the party executive of any wrong doing.

These prospective investors are heads of companies which, according to Mutharika, have a strong reputation for quality, innovation and integrity in the United Kingdom which will help towards the social-economic growth of Malawi. Mutharika said presently Malawi is a net importing and consuming country, but pointed out that his goal is to see the nation becoming a producing and exporting country "within a span of five years - a very ambitious goal indeed, but one that we believe is attainable". "Malawi offers, as you will notice and experience as you go around and meet various players in our economy, unlimited opportunities for investment both directly and under a Public-Private Partnership framework. "In order to achieve this, we need industry to substitute imports and to export, and this is where you come in," said Mutharika. He said the country's economy has experienced consistent growth over the last few years, with agriculture being an important contributor representing 32% of GDP in 2012. According to the World Bank, Malawi’s GDP growth has grown steadily over the last two year, and is predicted to grow to 5.1% in 2016. "In addition to increasing domestic demand for Malawi products, there is potential for Malawi to serve regional and global markets. Malawi has duty and quota free access to the EU under the Everything But Arms (EBA) framework, Enjoys tariff preference for exports to China, enjoys duty free access to India, and preferential trade benefits from the USA under AGOA. "Recently, Malawi signed the Tripartite agreement which makes it party to a combined market of over 700 million people and that merges the SADC, COMESA regions with the EAST African Community (EAC).  Manufactured products within this region are traded duty free within this region," explained Mutharika. He further claimed that Malawi has since 2012 undertaken a number of regulatory and institutional reforms focusing on reducing the regulatory and institutional burden to doing business. These include streamlining processes that make it faster, easier and cheaper to start a business. He said government has also reduced the number of procedures and time it takes to construct, occupy and connect a structure to utilities in Malawi from 18 procedures and 200 days to 10 procedures and 56 days, respectively. "Government has also reduced scrutiny fees from 0.8% of cost of the floor area to 0.4% since the fee is not directly related to provision of services. "Furthermore, planning approvals have been reduced from 60 days to 30 days, while the consultation process has been reduced from 21 days to 14 days," said Mutharika. He further emphasized, "In order for us to become a producing and exporting country we require the necessary tools; that is, the requisite industry and infrastructure that will produce and support production for both import substitution and export activities, and this is why you, my dear friends, are a very important ally to Malawi". Mutharika therefore said his government is committed to improving efficiency and effectiveness in the way the public sector supports private investors, and one of these commitments is being  demonstrated through the One Stop Service Center which his administration established at the Malawi Investment and Trade Center late 2014. "The purpose of the One Stop Service Center is to ensure that investor permits are granted at one place and in the shortest time possible so that establishment of your investment is not delayed. "You are allowed to invest in any sector of the economy without discrimination, as long as it is in an investment area that is productive to the economy of Malawi. "Furthermore, you are allowed to repatriate 100% of all your profits and dividends, and all your capital upon disinvestment. Our constitution protects foreign assets such that they can never be nationalized.  We also party to the Multilateral Investment Guarantee Agency (MIGA) convention and to the International Center for the Settlement of Disputes," explained Mutharika.

Chizondi steals show at Kuimba 10 launch in Mzuzu

Black Missionaries’ keyboardist Chizondi Fumulani might as well be another of the band’s assets in leading vocals if his performance during the launch of the Kuimba 10 at Mzuzu’s Tourist Lodge on Sunday is anything to go buy. Fans broke into an extraordinary jovial mood when Chizondi took to the microphone, moving away from the keyboards – his abode. Chizondi told Nyasa Times later after the show that he was “happy” their fans liked his performance. He said he has always been “encouraged” by band members to take leading vocals seriously. The album, which can also be described as full of “surprises”, is their eighth since the death of Evison Matafale – the band leader. It also features hip-hop artist Annie Matumbi and according to Anjiru the album has sold more than 7 000 copies in a month.

Teaching pupils under a tree which is used as their class

If teachers, teaching, learners, learning, core text books and decent classrooms come into your mind when the words school and education come into perspective; then you are not alone. You are like most of the people who think that having undergone different political dispensations; and having a different number of leaders who are good at political rhetoric then we should be able to provide all our primary schools with at least the basic necessities needed for teaching and learning. [caption id="attachment_93863" align="alignright" width="600"]Teaching pupils under a tree which is used as their class Teaching pupils under a tree which is used as their class[/caption] Theoretically, in the twenty first century, the concept of school embraces the aforementioned elements on top of other necessities like desks and chairs for every child, notebooks, chalks and chalkboards and other essential teaching and learning resources. Furthermore, the accepted wisdom is that there is supposed to be personal attention of each learner from the teachers. And mostly learning is supposed to take place at all levels of education with the whole ministry responsible for such in place. Practically the above postulation is mostly a wishful thinking of most rural school going children and dropouts. Mostly what takes place is contrary to what many expect. To most of the learners in the typical rural areas things like text books, notebooks, desks and chairs and four walls of a classroom are but a luxury they long to see as part of their learning process. Even to most teachers of rural primary schools, teaching is tough as they have to do without the basic teaching and learning resources such as textbooks. A teacher’s desk is even a thing that will distract the attention of many learners as they have never seen one. A teacher’s house in the rural setting is mostly a nightmare which leaks when it is raining and falls short of basic security standards. We cannot just sit and pretend that all is rosy for the rural child’s education. We are not looking for very sophisticated education like their counterpart in designated schools. What we are looking for is at least a basic education with all basic teaching and learning facilities and resources available and not the sub standard education taking place currently. We seem to have rationalized the substandard education under a tree where most of the rural child’s early years of education are taking place. Not that it is out of school authorities’ choice; but they are forced by circumstances and their eagerness to see the child learn in the absence of enough basic education facilities. Not that the child cannot learn under a tree, but education under the tree is proving to be chaotic to qualify for quality foundational education which is being advocated—if not just a lip service. Is this the kind of education that will help build our nation? Under the trees learners come properly bathed and clean but they go home dirty with the dust as if they have been to a certain manual work in the mines. Learning under a tree is like being exposed to a double edged sword. When it rains learning process is disturbed big time and the child is forced to go home without any learning at all because there is no roof and walls to shield them from the harsh weather conditions. When the oxcart is passing by, all the learning is distracted because the walls which could shield them from the petty distractions are invisible. When the winds are harsh learning is halted for the child to seek refuge. Education is a farce under a tree. Under the tree, the number of learners is too huge to be handled and taught by a single teacher who mostly end their days very tired and dejected. Where the classrooms are available, they are in dilapidated form and that learners are bundled like bags of bonya posing which is detrimental to their health. Most learners do not have a privilege to know a text book because education authorities think that text books can wait but not their hefty allowances. While this is the case, authorities seems not to care at all. Under the tree, the salary delayed teacher would rather spend time gossiping with their friends as to when their salary will be deposited in their bank accounts and leave the child helpless without learning at all. Even though the children arrive under this tree hoping they will learn how to read and write, and some basic numeracy skills; the day mostly ends only learning folklore or a song because that is the easy thing one can learn in a big group. Learners progresses into another level of an under the tree class even without internalizing the simple concepts of reading and adding figures which makes them to reach even standard four without knowing how to write their names. This is not by design but by default as the teacher cannot pay personal attention to teach each learner personally how to read or write because the learners are too many for personal attention. Instead the teaching is in form of singing without caring whether the concepts are sinking in the learners or not. While the teacher student ratio is high, and is contributing to miseducating the rural child, other teachers who could alleviate this problem are idle because the authorities do not care whether they are of use or not. If this is not substandard education then what can we call it? Many people will think this learning environment is normal. It should be noted that it is under this tree that the child’s foundation is distracted and distorted because the basic tenets of meaningful education are violated left right and center due to poor teaching and learning environment. If we do nothing, this will have a profound effect on us all. This poor environment has been rationalized by those in authority to make it normal. But do we really have to let this happening in the twenty first century?

Former Malawi Defence Force (MDF) soldier Macdonald Kumwembe defending himself on all charges of attempted murder and conspiracy to commit murder on former budget director Paul Mphwiyo has named his list of witnesses to take stand including former president Joyce Banda. Banda is currently abroad but Kumwembe has asked the courts to subpoena her to be a witness in the Mphwiyo shooting murder. Kumwembe said he mentioned Banda because during a rally at Lunzu when she was President after Mphwiyo’s shooting, she said she knew the people behind the incident. Mphwiyo’s shooting on 13 September 2013 led to the unravelling of the systematic looting of millions of government money dubbed ‘cashgate’. The former soldier, who Mphwiyo identified as his shooter and Pika Manondo will start defending themselves but they want Judge Micheal Mtambo to recuse himself from the case on the grounds that he will not offer a fair trial, but he has since refused. The judge is expected to make his ruling on whether he will recuse himself this Friday. Up to US $30 million was minted from the government payment system, where politicians and businessmen colluded with civil servants for payments for goods and services not rendered to government. Soon after Mphwiyo’s shooting millions of cash in Malawi kwacha, US dollars and South African Rands started pitching up in unlikely places like in car trunks, baby dolls, under beds or in pillow cases.

Director of Public Prosecutions (DPP) Mary Kachale has maintained her stand that the State is dealing with mafia-like operations in the case of the shooting of former Ministry of Finance budget director Paul Mphwiyo and has asked the High Court to revoke the bail of former Malawi Defence Force (MDF) soldier Macdonald Kumwembe , claiming he is a “threat” to presiding judge Michael Mtambo. The top prosecutor in her application in the High Court in Lilongwe said Kumwembe asked the judge to recuse himself from the case allegedly because he (Kumwembe) believed Mtambo had already pronounced a guilty sentence. “In his application to have judge Mtambo recuse himself, Kumwembe said the judge had already pronounced the guilty sentence on them, otherwise why did he [the judge] travel with a police officer with a gun on his way [back] to Blantyre? “Now, as State, we are wondering how he [Kumwembe] knew that judge Mtambo came to the courts without a policeman and left with one? He even named the policeman who escorted the judge. How did he get hold of such details? From his statement, we know that he has been following the judge; hence, the application.” Meanwhile, security has been beefed up for some judges handling Cashgate-related cases amid concerns of threats to their lives, the press reported . The press reported that during the conviction of former Ministry of Tourism assistant director Leonard Kalonga for his involvement in Cashgate last week, High Court judge Fiona Mwale refused to walk about 200 metres even with police escort, for fear of her life.

These included the approval by President Peter Mutharika to start implementing reforms in parastatals to make them more viable and contribute effectively to the socio economic development of the country. Chilima said to ensure that the reform areas which the parastatals themselves identified to make their organisations improve performance, the first step will be to finalise the State Corporation Policy whose absence led to conflicts in mandates of some parastatals. In the same vein, Chilima said a number of bills including the one on Public Service Appointment will be taken to parliament so that reforms that require legal backing are clearly documented and legalised. He cited the President's acceptance to relinquish some of his appointment powers, saying once the bill is passed it will mean that people, like Principal Secretaries, will now be going through a recruitment and interview process. Chilima disclosed that currently there are 41 Principal Secretaries apart from other Heads of Government Institutions. He said some Principal Secretaries have retired, some are yet to retire and others have been redeployed. “In particular, these efforts have seen some ministries which had two or three PS’s now having one. For Instance, Secretary to the Vice President is also Secretary and Commissioner for Department of Disaster Management Affairs. The right sizing process will continue until the intended reform purpose is achieved,” Chilima explained. Chilima emphasized that the reforms will not fail because the current administration wants the civil service to be effective and modern in running its affairs. The Vice President bemoaned lack of financial resources in the civil service commission, a problem that persists in every sector of Malawi life. “These reforms require a hefty financial budget. I am pleased to inform you that we have had a number of meetings with Development Partners who are supporting the reforms,” Chilima stated. He pointed out Approval of reforms in Parastatals, Decentralisation of Passport printing at the department of Immigration, Decentralisation of Teachers’ salaries, turning Green Belt Initiative into a Holdings Limited Company, Fertilizer Subsidy Programme, Parliamentary Committee on Public Service Reforms and IFMIS Enhancement Upgrade among others as some of the reforms currently taking place. On teachers, Chilima said the decentralisation of salary payment has made it possible for teachers to receive their pay in time and that soon they will be paid at district level. "We may even go further to pay them right in their homes through the use of modern technologies like mobile money," he said. As another reform success, Chilima also cited the decentralisation of passport printing to Lilongwe and Mzuzu as feat that has helped Malawians to stop travelling long to access passports in Blantyre. Soon, he said, services of Immigration, Lands, Tax, Business Registration and others will be found in Post Offices in what will be known as service centres. The Vice President also announced that there will be a commission which will be taking care of national development plans to ensure continuity if there is change of administration. Chilima also commended the Malawi media for publishing positive stories on reforms saying, “On numerous occasions the media has carried out positive stories about reforms on front page and on the same goodwill they have criticized responsibly. The media is a legitimate stakeholder in reforms hence it will be consulted just like any other stakeholders.” Meanwhile, President Mutharika has extended to June 2016 the tenure of the commission to give it more time to carry out its duties.

One of the activists pushing for federal system of government, Dr Binnah Shawa has called on President Peter Mutharika to first call a referendum vote for federation other than asking Malawians to vote on human rights issues such as homosexuality or abortion. The advocates for the federal system also feel that federalism would bring development competition among the three regions, since the regions would be able to plan for the most needed developments in their areas unlike now when all the decisions are made by the central government. President Mutharika mandated the Public Affairs Committee (PAC) to conduct a comprehensive assessment of the issue before a decision could be made. The federal system activists raised issues surrounding segregation and discrimination, road infrastructure in the North, status of Mzuzu City, education, and appointments in government and recognition of heroes from the North. They also complained about poor road network in the region saying despite campaign promises to upgrade some of them like the Edingeni-Euthini-Mpherembe- Nyika-Nthalire-Chitipa road, nothing has been done. They also queried why Mzuzu City gets a little budget of around K1 billion when other cities get as high as K2.2 billion in the national budget. Initially, the calls for government to adopt federalism started with few individuals from the country’s northern region in 2011, following a public outcry that the then president, late Bingu Wa Mutharika, brother to the current president, Peter, was oppressing the region in terms of development. For instance, Mutharika imposed a quota system policy of selecting students to public colleges; rather, than on merit, after he noted that most learners from the north were dominating public universities through the Ministry of Education’s merit selection system. Several quarters also accuse the incumbent President of supporting regionalism and nepotism by promoting people from his region and particularly his Lomwe tribe in public offices such as cabinet ministers, chief executives for parastatal institutions and other government departments.

Suspected shooter of former Ministry of Finance budget director Paul Mphwiyo, Macdonald Kumwembe, has asked High Court judge Michael Mtambo to recuse himself from continuing with the case, alleging bias and that has demonstrated to have a personal vendetta against his co-accused person, former minister of Justice and Constitutional Affairs Ralph Kasambara. [caption id="attachment_93910" align="alignright" width="548"]Kumwembe: DPP is playing gimmicks Kumwembe: DPP is playing gimmicks[/caption] In court affidavit seen by Nyasa Times, Kumwembe, a former Malawi Defence Force soldier, has included a letter dated July 10 2015 addressed to senior deputy registrar at the High Court’s Lilongwe Registry and also attached the Judge’s curriculum vitae (CV). Kumwembe, who was found with a case to answer on charges of attempted murder and conspiracy to commit murder, has also torn apart Director of Public Prosecution (DPP) Mary Kachale for what he called applying “cheap solution” to apply to court for revocation  of his bail. He wants Justice Mtambo to recuse himself from the case, saying he does not want to be caught in the crossfire of the alleged personal vendetta between Kasambara and the judge. Again, from reading your CV, one gets the impression that you have a personal vendetta or fight with a fellow lawyer, Raphael Kasambara, who also happens to be one of my Co- Accused persons in this matter. Kumwembe cited Judge Mtambo’s CV which indicates that he volunteered to represent an impregnated woman who sued Kasambara when he was Attorney General, when all lawyers were afraid to take on a senior government official – the client believed not to be in UK lost the case. The shooting suspect accused Judge Mtambo of misrepresenting facts and presenting himself as “a modern day Robin Hood” in as far as the dealing of Kasambara are concerned. “Now, to the extent that I am jointly charged with him [Kasambara] in a case of conspiracy, I can easily see myself being convicted simply because of the bad blood between yourself and Mr Raphael Kasambara. With all due respect, I do not want to be collateral damage in the personal professional warfare between your Lordship and Raphael Kasambara,” reads Kumwembe’s letter submitted to court. Kumwembe said he do not want to be “collateral damage” in the personal professional warfare between Judge Mtambo and Kasambara. Kumwembe says another ground calling for Mtambo’s recusal is that the judge allegedly requested for additional security to escort him to Blantyre when he delivered a ruling that Kumwembe, Kasambara and Pika Manondo had a case to answer. Top prosecutor Kachale told the court that the case was experiencing “mafia like antics”. But Kumwembe has accused the State led by Kachale of making “pathetic” allegations without any basis. In his affidavit, Kumwembe accuses Kachale of playing “deliberate gimmick “in seeking his bail to be revoked, saying the application is not made in good faith but as a “countervailing measure” against his application for Judge’s recusal. Kumwembe also accused Kachale’s attempt to throw into the case the murder of Issa Njaunju of the Anti-Corruption Bureau, saying such assertion is “an irresponsible and unprofessional conduct.” He said “it is another red herring dropped into the present case to create a negative picture of my co accused and myself so as to attract negative publicity.” Kumwembe says in the affidavit that he is convinced that the DPP “deliberately took out this motion so as to scare me away from continuing with my application for recusal of the Judge; and at the same time scare my two Co Accused person from supporting or actually joining me in my aforesaid application.” He argues that the DPP should have addressed her mind to the right to fair trial, Bail Guidelines Act, Criminal Procedure and Evidence Code and case law on the issue. Kumwembe further state that Kachale should have been aware that “there was no basis at all for moving the Court for revocation of my bail other than as part of her orchestrated strategy to harass, intimidate and muzzle me as an unrepresented accused person.” Judge Mtambo is set to make a ruling on whether to recuse himself or not, this Friday. Mphwiyo was shot outside his Area 43 home on September 13 2013 and his shooting led to mass arrests of civil servants and private sector businesspersons linked to Cashgate.

Former president Joyce Banda is scheduled to return home next month from South Africa, where she had been operating from, and government is preparing her retirement home. The former president, who is also leader of the opposition People’s Party (PP), has been out of the country on private engagements since June 29, 2014 when she left for the United States of America (US). PP publicity secretary and also acting director of administration, Ken Msonda has also confirmed about JB’s return but did not indicate the arrival date. “ I will hold meetings with all provincial and district committees to brief them on latest developments in the party and prepare for our party founder and President HE Dr. Joyce Banda’s home-coming,” said Msonda. While the actual date of return remains confidential, her spokesperson Andekuche Chanthunya, press aide Tusekele Mwanyongo and PP secretary general Ibrahim Matola confirmed the development in separate interviews. Matola said he could not provide the former president’s arrival dates, citing security reasons, but said the party will announce the date soon, insisting it will be next month. “JB is finally returning home,” confirmed Matola. Chancellor College-based political analyst, associate professor Blessings Chinsinga, has said Banda’s return will be good for her party which is currently in civil war. “Joyce Banda needs to return and put the house in order, otherwise, what we see is a result of power struggle because there is leadership vacuum. Let her return, or give up power and facilitate smooth transition so that someone else takes over,” urged Chinsinga in comments attributed to him in the press. In May this year, retired chief justice Richard Banda wrote foreign missions and development partners in the country, asking them to intervene in “repeated political harassment and persecution” of his wife, JB, by the Peter Mutharika administration. In a letter dated May 13 2015, the former chief justice said the family is convinced that “the many unsubstantiated accusations and allegations” could be a precursor to much more sinister motives. Some of the former president’s major engagements include meeting former United States president Bill Clinton at the Clinton Global Initiative (CGI) in Morocco on May 5 and receiving of her doctorate degree on May 15.
